Indigenous Australians

The Aborigines Protection Act 1909 (NSW) was a law that changed Indigenous Australian lives forever. The act enabled the New South Wales Board for the Protection of Aborigines to essentially control the lives of Aboriginal people. It was the Aborigines Protection Act 1909 (NSW) that had major provisions that resulted in the containment and suffering that Aboriginal people endured. This suffering included the practice of forcible removing Indigenous children from their families. These major provisions help us understand what the Aborigines Protection Act 1909 (NSW) involved and the impact it has had on the daily lives and cultures of Indigenous Australian peoples today.

Australia was first claimed by Captain Cook in early 1770, but it wasn’t settled until 1788 when the first fleet of 11 ships arrived at Botany Bay, carrying 1,530 passengers - mostly convicts, as well as some marines and officers. They moved to Port Jackson to begin establishing a settlement. Specific prisoners were chosen for the trip, the ones with skills in building, farming and other things that would have been useful to create a “liveable” environment for the new inhabitants. The first “free” settlers only arrived in 1793, thus beginning the colonisation of New South Wales.

Since the time of federation the Aboriginal people have been fighting for their rights through protests, strikes and the notorious ‘day of mourning’. However, over the last century the Australian federal government has generated policies which manage and restrained that of the Aboriginal people’s rights, citizenships and general protection. The Australian government policy that has had the most significant impact on indigenous Australians is the assimilation policy. The reasons behind this include the influences that the stolen generation has had on the indigenous Australians, their relegated rights and their entitlement to vote and the impact that the policy has had on the indigenous people of Australia.

After many years of European settlement in Australia, many Aboriginal people had been removed from their families and placed into schools with white Australians. This was due to the ‘protection policy’ laws that encouraged the removal of Indigenous children. Because fewer indigenous children were able to learn about their own culture, there was a slow decline in the culture of the indigenous people. As a result of this, there were continued tensions between the free settlers and Indigenous people as they had no roles in the government and couldn’t vote. This made them feel as if they were excluded from greater society and had long term negative impacts upon their sense of belonging to the new

Unfortunately on the other hand, some rights and freedoms have not improved at all or have even worsened.

spirituality. Aboriginal spirituality is passed on orally by elders through myths and rituals. Without knowledge of their traditional languages, young people could not learn about the spiritual beliefs of their people. This spirituality was all encompassing, affecting not only their thoughts about the spirit world but also their knowledge of places, plants and animals and traditional skills such as fishing, trapping, and tanning (Blair et al., 2002, p. 96). As Steckley and Cummins have pointed out, without access to the elders’ knowledge of nature, young people lost access to the beliefs and practices their people had developed over thousands of years (2001, p. 17). All aboriginals are linked to the Dreamtime through their totemic creation ancestors, whose stories are passed on through generations. Just as they would care for their family or tribe, they are obliged to care for their ancestral spirits existing in their land. It is important to remember that ancestral spirits are not necessarily ‘Gods’, but instead they are natural features of the land. As the Ancestor Spirits travelled the land, they taught the Law. When Aboriginals say they have a spiritual connection to the land, this relationship exists through the Law developed at the period of formation that includes a system of totemism. A totemic being represents the original form of an animal, plant or other object as it was in the Creation Period. The Kumbumerri Yugambeh people’s totem is the Eagle. ‘What is meant by totemism in Aboriginal Australia is always a mystical connection, expressed by symbolic devices and maintained by rules, between living persons, whether as individuals or as groups or as stocks, and other existents—their ‘totems’ —within an ontology of life that in Aboriginal understanding depends for order and continuity on maintaining the identities and associations which exemplify the connection.’ (5.3) Totems not only create a sense of belonging and spiritual connectedness to the land and others in the tribe, but they also offer hints to the person's

These philosophical ways of being and abiding by are supported by the Dreamtime. The Dreamtime can be explained as ‘how the world came to be’ for Australia’s First People, centered around ‘how people must conduct their behavior and social relations’ (Broome, 2002, p. 19). There are estimated to be 600 different Indigenous countries that exist amongst the Australian continent, all with different ways of ‘doing’ (Edwards, 1998). The Dreaming is an important way of passing on knowledge, cultural values and belief systems from generation to generation (Australian Government, 2015). The deep connection that Aboriginal people have to their land is also an important concept relation to the concept of The Dreaming. The land is where the events of the dreaming occurred, with the spirit beings of The Dreaming, forming sacred parts of the Australian landscape (Edwards, 1998, p. 81). This spiritual way of being is also linked to elaborate laws of kinship (Phillips, 2005).

Aboriginal spirituality is directly linked to dreaming. The dreaming is the term which refers to the past, future and present of Aboriginal spirituality. The dreaming grasps the Aboriginal ideas of creation. It is the foundation on which the Aboriginal religion is built upon. The impacts of dispossession on Aboriginal spiritualties concerning separation from the land, the stolen generation and separation from kinship group is discussed. Departure from the land started with the European settlement. It removed the sense of belonging and sense of spiritual identity. One of the first forms of dispossession even date back to when the first fleet arrived in 1778. The removal of Aboriginal people from their land had a detrimental effect on their spirituality

The Effectiveness of the Law in Achieving Justice for Indigenous People In relation to Australia, the term ‘Indigenous peoples’ refers to two distinct cultures of people who inhabited the land prior to European settlement – The Aboriginals and the Torres Strait Islanders. This population declined dramatically over the 19th and early 20th century due to the introduction of new diseases from European settlement, Government policies of dispersal and dispossession, the era of protection, assimilation and integration causing a cultural disruption and disintegration of the Indigenous peoples. The rights and freedoms of Aboriginal people have changed significantly during the 20th century after facing many years of neglect and inequalities. In that time, change in indigenous rights and freedoms was brought about as a result of government policies, political activism and legal changes.

When European colonists settled in Australia they treated the Aboriginal people extremely different to that of their fellow white men. The Aboriginals were not seen as first class citizens through the European eye and as a result were victims of extreme oppressions and had nearly no rights or freedoms. Since then Aboriginal people have fought to be treated equally to the white men through various different ways. I will discuss the previous struggles faced by the Aboriginals, the Australian strife for equality and finally the level of success and degree of rights and freedoms given to Aboriginals in modern Australia.

Human rights are the rights of humans, regardless of nationality, gender, race, or religion. We should all have this in common as we are all part of humanity. However, Indigenous people did not always have these rights (Ag.gov.au, 2015). Aside from basic human rights, Indigenous people also have their own rights specific to their culture. Before 1967, Indigenous people had different rights in different states and the Australian federal government did not have any jurisdiction over Aboriginal affairs until Australia’s constitution was amended for this purpose in 1967 (Moadoph.gov.au, 2015). Between 1900 and the present time, there have been significant changes to the rights of Indigenous Australians. The effects of the European Settlement on the Indigenous people of Australia have been devastating. When white people began arriving in Australia, the Aboriginal people believed them to be ghosts of ancestor spirits. However, once they realised the settlers were invading their land, the Aborigines became, understandably, hostile (Slater & Parish, 1999, pp.8-11). In 1788, the total Indigenous population was believed to be between 750,000 and one million. By 1888, the Indigenous population was reduced to around 80,000 Australia wide (Korff, 2014). The three main reasons for this dramatic decline were the introduction of new diseases, violent conflicts with the colonisers, and settlers acquiring Indigenous land (Digital, 2015). Attempts have been made by the Australian government to protect Aboriginal culture, beginning in the late 1920s with the creation of special reserves. Aborigines are now officially recognised as Australian citizens, and
