The year 2013 celebrates the 20th anniversary of the signing of the Family and Medical Leave Act (FMLA) by President Clinton. Since then, many families has had the advantage of this law. In 2013, President Obama signed new regulations to the FMLA that covers service members and veterans.

Kalamazoo County Road Commission (2015), the plaintiff Terry Tilly alleged that the Kalamazoo County Road Commission violated his right to take medical leave provided by the Family and Medical Leave Act. The KCRC’s personnel manual, which definitively advises that the manual serves “a basic guide to basic benefits, working conditions and policies” in part states that, “Employees covered under the Family and Medical Leave Act are full-time employees who have worked for the Road Commission and accumulated 1,250 work hours in the previous 12 months.” There are several statutes that specify a minimum employer size in term of the number of employees in the roster (Walsh, 2013, p. 10). Under section 2611 of the Family and Medical Leave Act of 1993, an employee who works for a company that does not meet the FMLA 50/75-Employee Threshold is not eligible for FMLA (2010). The trial court, therefore, ruled in favor of the Kalamazoo County Road Commission, dismissing Mr. Tilley’s FMLA claim. However, the Court of Appeals would later overturn the dismissal of the case. Although the employer did not meet the FMLA 50/75-Employee Threshold, making Mr. Tilley an ineligible employee under the FMLA, the company’s employee handbook misrepresented his eligibility to apply for FMLA benefits. The manual failed to mention the FMLA 50/75-Employee Threshold, so Mr. Tilley was in fact protected under the FMLA

This economic need along with modern attitudes toward gender equality has resulted in women being represented in the workforce in greater numbers. Employment Laws- Any changes to employment law is a legal factor which can have an impact on many organisations including Homes For You . In our analysis one change to employment law that was considered was the possible increase in parental leave (this may be increasing from three months to four months with effect in March 2013.) As a large number of our employees have children we need to put procedures in place to deal with this. We need to ensure all HR staff are aware of the changes and of procedures to grant a parental leave request and also look at ways to cover service if and when our employees chose to take advantage of this (cover may include offering overtime to other workers, or the possibility of recruiting temporary staff)
The case of Kathryn Mc Neil deals with the issue of separation in the workplace regarding the nonperformance of a single mother whose work was suffering because of the tremendous additional burden of raising a child. The case was written in 1994 but in the intervening years significant decisions have been made by the law (in the US) protecting the rights of the single mother. The debate is no longer exclusively about professionalism versus corporate responsibility but the new phenomenon of a third gender in the workplace.
