Outcome 4.1 Explain the policies and procedures of the setting or service in response to accidents, incidents, emergencies and illness.

Riddor (the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations.) influences a Health Care Setting as it ensures all staff keep records of injuries, diseases and dangerous occurrences that have happened in the care home. This ensures that everyone knows the incidents have occurred, they have been dealt with and what staff and equipment where involved in the process. Also all staff should be fully aware of Riddor and the procedure in which you report any incidents to the HSE (Health and Safety Executive) as it is a necessary part of your job as a Health Care practitioner.

2.2- Demonstrate how to deal with hazards to minimise risks to the health, safety and security of children and young people.

Under this act, employers are responsible for reporting certain types of incidents, accidents or illnesses to the Health and Safety Exectutive, or the local authority.

All healthcare workers are required to report anything that effects the environment. For example speaking to a senior staff member or manager straight away, explaining the problem so it can be dealt with properly. Reportable incidents: deaths, major injuries, some work-related diseases; dangerous occurrences – where something happens that does not result in an injury, but could have done; registered gas fitters must also report dangerous gas fittings they find, and gas conveyors/suppliers must report some flammable gas incidents. RIDDOR applies to all work activities but not all incidents are reportable

1.2 Identify the lines of responsibility and reporting for health and safety in the work setting

Reporting of Injuries,Diseases and dangerous occurrences regulations of 1995 requires the reporting of work-related accidents, diseases and dangerous occurrences. The Act applies to all work related activities, but not to all work related incidents. The objective of the regulations is to enable the enforcing authorities to identify where and how risks arise and to investigate serious accidents so as to prevent them from occurring in the future and thus providing a safer work environment. The enforcing authorities can then help and advise you on preventive action to reduce injury, ill health and accidental loss,the main points of our own policy that relate to this are:

Section 2 – Understand the purpose of health, safety and security procedures in a business environment

If you have concerns about the care and safety of service users and feel like you can’t go to your manager then you have the option to contact some big and confidential organisations such as Care Quality Commission (CQC) or Health and Safety Executive (HSE) or environmental health who can also offer support and information and give you any answers you may need to any concerns.

However, the protection doesn’t come with absolute simplicity. Keeping and providing adequate documentation to support their stance can determine the outcome of legal battles. A specific example involves the United States Department of Labor and the Occupational Safety and Health Administration (OSHA). Section 5 states, “Each employer shall furnish to each of his employees employment and a place of employment which are free of recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” Having pictures, standard operating procedures, or statements present when reporting can influence management to respond more timely. If employees aren’t able to develop abatements through their front-line supervisors and organization, they may report using the anonymity of OSHA. However, employees must be swift with their decision to report for specific matters. Per 29 Code of Federal Regulations (CFR) Part 1977 Section 11(c)(2), employees have within 30 days of the violating event to report. However, ethical management would prevent employees from having to go to this extent. Some cases of employee reporting provide exposure to a hazard not identified by front-line supervision.
