Thomas Mark Criminal Justice 105 Police Misconduct What is police misconduct? It can be defined as any action performed by a law enforcement officer that is unethical by established employment guidelines, unconstitutional, or a crime with in itself. When people hear the term “police misconduct” they automatically think of a police officer using unnecessary force against a civilian. While that is a form of police misconduct it is not only form. Throughout this paper I will bring light to the many types of police misconduct that can happen in the law enforcement industry. While being a police officer, you have guidelines and rules that you need to follow just as if you worked as a chef or even a sales associate you have rules …show more content…
This can happen in the form of beating a person while making the arrest or using any unnecessary force against the person. Sometimes police beatings can be racially based or can happen due to an argument between the officer and the person. The use of excessive force in the law enforcement industry is not tolerated in any form. If a police officer is found guilty in using unnecessary force on a person they will be terminated from their job. Using unnecessary force is one of the more know types of police misconduct being that when excessive force is used on a person there is normally charges pressed on the officer and the case is brought into court and therefore into the media. Another type of police misconduct is sexual harassment. This would be when a officer sexually harasses a male or female individual. Most sexual harassment case are from a male officer to a female victim. Some police officers like to take advantage of their authority and will go as far to rape individuals just because they feel that the fact that they are a police officer, they will be able to get away with it. A report done in 2010 showed that 6,613 law enforcement officers throughout the United States were involved with police misconduct. 9.3% was sexual harassment charges of police misconduct. Officer-involved sexual misconduct describes an entire subset of police misconduct that includes non criminal complaints such as consensual sexual activity that occurs while an officer is on-duty,
Police has the power to put anyone in Prison especially if they are not committing anything seriously. One of the reason is because Colored citizens don’t have higher class, meaning on poverty, no wealthy jobs etc. meaning that they would do crime. War on drugs is a significant factor in the High incarceration rates for African-American.
When enforcing the law, for police officers not two situations they encounter are ever the same, even when examine a large number of situations over an extended period of time. The officers are usually in the
Policemen not only have to follow a set of rules and legislation, but they also must behave in a decent manner while on duty as well as off duty. Unfortunately, nobody is perfect, and police officers also make wrong decisions that could jeopardize the integrity of their police department. Often people do something that they know is wrong. However, they still do it because they feel no harm will come to them or they think nobody would ever find out. For instance, cheating on a test is wrong, but people do it because they think they can get away without the professor finding out.
The over use of force would include: unjustified shootings, severe beatings, fatal chokings, and rough treatment. Policing is a very dangerous field, the use of force is expected but the question still remains, how much force should police use? Police officers are given a continuum of force to help prevent excessive use of force, but there are still many officers that do not abide by
Police Brutality against African American people has begun to take a toll on our communities. African American communities cannot even trust the police, because of the way they are being treated unfairly by a police officers of them distract or their state. Which is why the police are being coming more advanced in technology, but still fail to use their powers as an officer correctly. This cause the police officers are using misconduct against African American people when confronted by them. This research leads me to conclude that the police department of many states across the United States becomes more corrupted every day because of the lack of order in our police departments. In this essay, I will argue that the policing between black
The summer of 2015, on June 15th, my cousins, brothers and I were stopped by Montgomery county police officers. A robbery was reported and we “supposedly” fitted the descriptions. It was five African Americans, four males, and one female. We eventually found out the description they had told us was completely false. The women who reported the robbery came to our location to identify us and angrily told the cops that she said there were only three African-American males and they all had dreads, which none of us fitted that description. This experience of mine may sound surprising or uncommon to others, but this exact situation happens to many other African Americans. It has become a common way African Americans live in America.
1 out of every 116 officers allegedly engaged in misconduct. That means in almost every police department where there is there is at least one officer who is engaging in misconduct. Already this year of
African Americans, Whites, and Hispanics often perceive American social institutions, including the criminal justice system in starkly different terms. Research has shown that race is one of the most salient predictors of attitudes toward the police and other criminal justice institutions: African Americans are more likely than whites to express dissatisfaction with various aspects of policing. Whites tend to hold a favorable opinion of the police, favor aggressive law enforcement, and are skeptical of criticisms of the police. African Americans and Hispanics, however, are more included to viewing the police as contributing to their subordination through both legal and extralegal practices, as frequently involved in mistreatment of minority citizens. Their position increases the chance that they will see police misconduct as both a general problem and one that particularly afflicts Hispanics and African Americans. The reality is that most African Americans and Hispanics, like many Whites, want law enforcement amplified, though they want it achieved in a fashion that reduces abuses. When a figure of authority – such as a police officer - abuses their power, they are involving themselves in acts of misconduct. If an officer abuses their power in return for personal gain, then they are involving themselves in corrupt conduct (Farlex, 2008). Personal gains would be making a profit or obtaining other benefits through illegal ways such as bribery, selling drugs, stealing, and extortion. Within the police department, acts of misconduct and corruption take the form of procedural, criminal, and unconstitutional violations (Farlex, 2008). Procedural is a form of misconduct occurring when officers go against the rules and regulations
A man is in his car and is pulled over for having a suspended license, and for going 60 on a 40 road. The officer walks over to the car to see the man crying. The man claims that he was rushing to get to a relative's funeral. When asked to get out of the car he resists and the police officer grabs his arm. The man yanks his arm back and the officer pulls him out of the car and brutally beats him.
The movie I chose was “Serpico.” The setting of the movie begins with Frank Serpico the main character graduating from the Police Academy, He is determined to be a “good” cop and represent everything that the image of a law enforcer is meant to be. However, where there is bad there is good and the police force is no exception. No matter where Serpico goes Police Corruption seems to be all around and his morals are challenged time and time again. He however wants to change this and break down on Police Corruption, but of course with every department being corrupt instead of making it better for himself he is slowly digging his grave. The movie shows that corruption in the
In your essay, the topic you’re joining is about police brutality . I can tell because in your introduction when you have mentioned of world issue of police brutality and the abusement of power you seen on social media as well news. The thesis you offer as an answer to this issue at first by addressing the issue of continuation of police brutality which are seen on social media and other outlets and how citizens are frighten and brutalized. By the end of the essay, we come to an understanding that there is a lack of training to protect citizens, racial profile, excessive force on the minorities as well in the minority communities these reasons are that police officers is biased and use unreasonable act .
Law enforcement, in some form, has existed for centuries and since its creation there has been numerous improvements. Improvements have come about because of community changes and the need for more effective ways of policing the people. As crimes became more fierce and complex so did the need for the investigation and solving of these crimes. Criminal investigative techniques were not just born from thin air, some thought and planning had to go into figuring out the proper ways to go about doing things. Pioneers of the criminal justice and criminal investigation field such as August Vollmer, Alphonse Bertillon, Edward Henry, and Edmond Locard have made superior contributions to the development of criminal investigative techniques. These techniques have impacted the way police operate today and set a substantial base for law enforcement to build on.
Special units in police forces are essential to the function of any organization, however some of these special units might evolve into feeling superior to the rest of the agency. The mentality of doing it their own way sets in and more likely than not this behavior is not cohesive with the policies and procedures in place by the agency. Unfortunately, this attitude develops from not being checked, and leads to the unit feeling as though they are untouchable. When not having checks and balances
The relationship between the LGBTQ community and the police services has been filled with harassment and discrimination based on sexual orientation and gender identity. Although the number has decreased over the years, numerous individuals of the LGBTQ community are still reporting complaints of discrimination that are the cause of police misconduct, including verbal harassment, physical and sexual abuse.
