The New Jim Crow by Michelle Alexander

Michelle Alexander’s book, The New Jim Crow: Mass Incarceration in the Age of Colorblindness, examines mass incarceration in the United States, why the criminal justice system works the way it does towards minorities, the detriments associated with mass incarceration as it relates to offenders, and much more. In the introduction of her book, Alexander immediately paints the harsh reality of mass incarceration with the story of Jarvious Cotton who is denied the right to vote among other rights because he, “has been labeled as a felon and is currently on parole” (1). Other information Alexander presents in her introduction are her qualifications as an author of the book, and gives a brief summary of each chapter and how each one is laid out. Her qualifications are she is African-American civil rights attorney with the American Civil Liberties Union (ACLU) and is also an Associate Professor at the University of Stanford Law School. From a critical standpoint, Alexander seems very qualified to write on the topic, being part of the marginalized group and also being an expert in the legal field of which the topic covers, enhances her ethos to where one could consider her an expert in mass incarceration topics, as they relate to African-Americans. Overall, the introduction of her book does a great job starting out giving a stark reality of topic at hand, giving brief statistical references about mass incarceration in the United States, and giving an outline for her book.

Glen Loury argues in his essay called “A Nation of Jailer” that the United States is a nation that follows a society that has been affected by racial bias. Loury claims that the people who are targeted by law are racial discriminated. Loury mainly talks about the “poorly educated black and Hispanic men who reside in large numbers in our great urban centers.” (1) Loury has made a clear and strong point. Loury shows his points in three main ways. Loury emphasizes his points by using ethos, logos, and pathos. Loury uses many well-known characters in his writing, and Loury uses strong phrases that impact the reader emotionally and questions to make sure the reader has some sort of connection to Loury’s evidence. During the Civil Rights Era, many black power movements strived to prevent the New Jim Crow from happening. The black man was being oppressed during segregation and treated like animals. The white supremacy, only visualize African Americans as slaves, people who should not be a part of the United States. Martin Luther King Jr. and Malcolm X drove men and women to fight for his or her rights. However, that was not enough to stop the white supremacy from oppressing African Americans. The Civil Rights movement did put an end to public segregation. It did not put not put an end to the laws being made by the government, which is dominated by the white race. In the book, The New Jim Crow by Michelle Alexander discussed how the Civil Rights and black power movements helped African Americans gain their equal rights, but did not help to gain political power. Mass Incarceration is where the African Americans’ lives end because of the social structure created by the government. Blacks are mostly in the lower class because after the Great Depression, Roosevelt only created laws for whites. This allowed the white community to build and move out the cities into better neighborhoods. Leaving the black community behind. Base on how the black community was viewed as a race and social status, gives this race a higher chance of being behind bars.

In making the case that mass incarceration is the new version of Jim Crow, Alexander moves through a history of racial caste systems from slavery to Jim Crow. Alexander demonstrates this history by explaining that it was during these racially periods of American history that the platform was set for maintaining a black underclass through the use of race-neutral language. Alexander’s main premises focuses on the large majority of African American men imprisoned today, as she reflects on the direct result of it that “young black men today may be just as likely to suffer discrimination in employment, housing, public benefits. And jury service as a black man in the Jim Crow era- discrimination that is perfectly legal, because it is based on one’s criminal record.” (Alexander, 181) Alexander points out not only how a significant portion of black men are ending up in prison, but how when released they face discrimination because of their criminal record making them unable to rehabilitate their lives and putting them back into the ghetto. Discrimination is a main factor which puts people of color in the penal system, and a main factor which when getting out keeps them from changing their lifestyle for the better.

Mass incarceration is known as a net of laws, policies, and rules that equates to the American criminal justice system. This series of principles of our legal system works as an entrance to a lifelong position of lower status, with no hope of advancement. Mass incarceration follows those who are released from prison through exclusion and legalized discrimination, hidden within America. The New Jim Crow is a modernized version of the original Jim Crow Laws. It is a modern racial caste system designed to keep American black men and minorities oppressed with laws and regulations by incarceration. The system of mass incarceration is the “new Jim Crow” due to the way the U.S. criminal justice system uses the “War on Drugs” as the main means of allowing discrimination and repression. America currently holds the highest rate of incarceration in the world, and even more African American men imprisoned, although white men are more likely to commit drug crimes but not get arrested. The primary targets of the criminal justice system are men of color. Mass incarceration is a rigid, complex system of racial control that resembles Jim Crow.

In the new proactive book, The New Jim Crow: Mass Incarceration in the Age of Colorblindness, Michelle Alexander dives into the not so complicated racial issues that plague this country that we tend to ignore. In all of history, African Americans have had to constantly fight for their freedoms and the right to be considered a human being in this society. It’s very troubling looking back and seeing where we have failed people in this country. At the turn of the century, when people began to think that we had left our old ways behind, this book reminds us that we are wrong. Racism is still alive today in every way, just in different forms.

The third critical book review for this class takes a look at “The New Jim Crow” by Michelle Alexander published in 2012 by the New York Press. This book analyzes the problem with the incarceration system in the United States today that unfairly affects the African American community. This incarceration system is continuing to separate families, strip men of their freedom, and effectually make them into second class citizens upon release from prison as “free” men. She even describes that those who are convicted of these crimes are “relegated to a racially segregated and subordinated existence” (Pg. 4). Michelle Alexander is not only a published author but is also an active Civil Rights activist all while currently employed as an associate professor of law at Ohio State University. It is a very interesting read that coincides with where our class discussions have recently been. It argues that we as a country have not ended racial discrimination but just transformed it into a new type of caste system. It is an eye opening book that created an uncomfortable feeling while reading due to my level of ignorance on this topic prior to taking this class. I believe that this book will serve as an important narrative into fixing the race problems in this country because it brings to light what needs to be fixed. If any progress is made it will be because of books like this that expose the problems but starting to fix them will be the next step.

Alexander also focuses on the social oppressions that African Americans have suffered throughout the years, until now. In this essay, I will discuss how the system of control was constructed, Alexander’s compelling historical analysis, and if the current system would be easier to dismantle. I would like to start by delving into how the system of control was constructed.

Michelle Alexander’s The New Jim Crow: Mass Incarceration in the Age of Colorblindness goes into great detail on race related issues that were specific to black males, the mass incarceration, and how that lead to the development of institutionalized racism in the United States. She compares the Jim Crow with recent phenomenon of mass incarceration and points out that the mass incarceration is a network of laws, policies, customs and institutions that have been working together to warrant the subordinating status of black males. In this paper I will go into a brief examination of the range of issues that she mentions in her book that are surrounding the mass incarceration of black male populations.
