During the exchange of gunfire, one of the teens, 16-year-old, A’donte Washington fired a weapon at one Millbrook officer who then returned fire, killing Washington. The other subjects were arrested. The Charges Burglary, theft of property and felony murder. The Law Felony Murder Rule: The felony murder rule is a law that allows anyone who is accused of committing a violent felony to be charged with murder if the commission of that felony results in the death of someone, even if they didn’t physically kill the person. The Prosecutor None of the other individuals involved in the burglary pulled the trigger that killed Washington, however the prosecutor used his discretion to charge them all with burglary and theft, but also the murder of Washington, under the Felony-Murder rules of that state.
